Are Orbeez safe? What parents of kids 4–7 should know

Are Orbeez safe? Orbeez are water beads, and retail listings label them for ages 5 and up; Consumer Reports reported in 2013 that the package warned of a choking hazard for under 3 and said not suitable under 5, and in 2023 reported that a lawsuit says the "choking risk" label is inadequate. The CPSC says swallowed water beads can expand and block a child's intestines, and a federal safety standard for water bead toys took effect on March 12, 2026. We found no CPSC recall of Orbeez and no government action naming the brand. A 2023 class action by parents against Spin Master is a private lawsuit.

What are Orbeez?

Short answer: A brand of water beads: tiny polymer beads that grow many times bigger when soaked in water.

Spin Master bought the Orbeez brand from Maya Toys in 2019. Orbeez are sold in packs and in play sets, such as foot spas and sensory kits.

Are Orbeez safe? What the labels and the CPSC say

Short answer: They're labeled 5+, and the federal government regulates water bead toys because of swallowing risks.

  • Retail listings: 5+.
  • Package (Consumer Reports, 2013 testing of earlier packaging): "Choking hazard not for children under three years" on the front; "Not suitable for children under the age of five" on the back. Orbeez told Consumer Reports its tests show the toy is safe for the children it's intended for.
  • CPSC: a swallowed water bead can expand and block the intestines. A federal standard for water bead toys took effect March 12, 2026.

Lawsuits and store bans

Short answer: Parents sued; big retailers changed their policies; we found no government action naming Orbeez.

In October 2023, parents filed a class action against Spin Master over Orbeez warnings (Gamino v. Spin Master); it's a private lawsuit, and we couldn't confirm its status. Fox 9 reported in February 2024 that Target (water beads marketed to children under 13), Amazon (marketed to children), and Walmart (toys and crafts marketed to children under 9) had changed their policies. We couldn't confirm which Orbeez products are sold in the US as of October 2026.

The habit kids may copy: everything in the mouth

Water beads look like candy, and small children explore by putting things in their mouths.

Try tonight: the look-don't-taste rule

Make a house rule together for small things that look like food: "If it's not food, it stays out of my mouth." Let your child say it back and decide where small toys live, up high. In our program, this is the lesson "My Fort": the rules I keep.
